Terms of Sale and Use

This document is a translation of the original French "Conditions Générales de Vente et d'Utilisation" (CGVU) provided for convenience. In the event of any discrepancy, the French version shall prevail, as the Platform operates under French law.
These Terms of Sale and Use (hereinafter the "Terms") govern the relationship between Piecemotooccasion.eu, operated by Tony B, registered under SIREN number 810 953 562, whose registered office is located at Allée des Colchiques, 72300 Sablé-sur-Sarthe, France, hereinafter referred to as "the Platform," and any individual or legal entity using the Platform, hereinafter referred to as the "User."
The Platform connects Sellers (private individuals or professionals wishing to sell used motorcycle parts) with Buyers. Piecemotooccasion.eu is not the seller of the parts listed: it acts as a technical intermediary and online platform operator within the meaning of the French Consumer Code (Code de la consommation).
1. Purpose
These Terms define the rights and obligations of the parties in connection with the use of the Platform, and the listing and purchase of used motorcycle parts via piecemotooccasion.eu.
2. Acceptance of terms
Registration on the Platform and any order placed constitute unreserved acceptance of these Terms. The User confirms having read and accepted these Terms before creating an account or confirming an order.
3. Registration and user account
Registration is free and open to any adult. The User agrees to provide accurate, complete information and to keep it up to date. Creating a Seller account may require identity verification (KYC) via our payment provider, Stripe Connect.
4. Listings and products
Parts offered for sale are described by Sellers under their sole responsibility. The Platform does not guarantee the conformity, authenticity, or actual condition of the parts listed. Photographs are provided by the Seller and are for indicative purposes only.
Listings for stolen or counterfeit parts, parts subject to unmet homologation requirements, or parts presenting a safety risk (for example: critical braking components without inspection) are strictly prohibited.
5. Price and commission
Prices are freely set by Sellers, in euros (€), inclusive of all taxes when the Seller is subject to VAT, excluding delivery costs.
The Platform charges a commission on each successful transaction, the rate of which is specified in the Seller dashboard and when a listing is published. This commission is automatically deducted from the payout made to the Seller via Stripe Connect.
6. Order and payment
The Buyer confirms their order by clicking the "Pay" button at the end of the checkout process. A confirmation email is sent to both the Buyer and the Seller.
Payments are processed by Stripe Payments Europe Ltd, a licensed payment service provider. The Platform does not store any banking data. Funds are held in a Stripe escrow account and released to the Seller once shipment is confirmed, less the Platform's commission.
7. Delivery
Delivery is the Seller's responsibility. Terms (carrier, timeframes, costs) are specified in each listing. The Platform is not a party to the shipping contract. Risk transfers to the Buyer upon receipt of the parcel.
In case of delay, the Buyer may contact the Seller directly via the Platform's messaging system. If there is no response within 7 days, the Buyer may refer the matter to the internal mediation service (Article 14).
8. Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, when the Seller is a professional and the Buyer a consumer, the Buyer has a period of 14 days from receipt to exercise their right of withdrawal, without justification.
Between private individuals, the statutory right of withdrawal does not apply. Sales between private individuals are governed by Articles 1641 et seq. of the French Civil Code (warranty against hidden defects). The Platform nonetheless encourages private Sellers to offer a courtesy return period.
9. Warranties
Professional Seller: parts are covered by the statutory warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
Private Seller: only the warranty against hidden defects applies. The Buyer has a period of 2 years from discovery of the defect to take action.
The Platform cannot be held liable for damage resulting from improper installation or use of purchased parts, nor for any mismatch between a part and the intended vehicle, which is the Buyer's responsibility to verify before purchase.
10. Seller obligations
- Accurately describe the actual condition of parts (condition, defects, mileage, traceability)
- Legitimately own the parts listed for sale (proof of ownership upon request)
- Ship within the announced timeframe and provide a tracking number
- Respond to Buyer inquiries within 48 business hours
- Comply with applicable tax and social obligations (income declaration, legal status)
11. Personal data (GDPR)
The Platform processes Users' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. The data collected is necessary for managing accounts, transactions, and customer relations.
12. Cookies
The Platform only uses technical cookies necessary for its operation (CSRF, session). No tracking or advertising cookies are set without explicit consent.
13. Intellectual property
All elements of the Platform (editorial content, visual identity, logos, source code) are the exclusive property of Piecemotooccasion.eu. Listings and photos published by Sellers remain the property of their authors, who grant the Platform a non-exclusive, royalty-free license to use them for the duration the listing is published.
14. Mediation and dispute resolution
In the event of a dispute between a Buyer and a Seller, the Platform offers an internal mediation service. Users are encouraged to contact customer support at coucou[@]piecemotooccasion.eu before taking any legal action.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge:

15. Reporting illegal content (DSA)
In accordance with Regulation (EU) 2022/2065 on Digital Services (DSA), any User may report illegal content (fraudulent listing, counterfeiting, etc.) via the dedicated form or by email at coucou[@]piecemotooccasion.eu. Reports are processed within 7 business days.
16. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts shall be those of the jurisdiction of the Platform's registered office, except where mandatory law provides otherwise (in particular in favor of the consumer).
